Four of 27. Belgium joined Slovakia, Lithuania, and Malta as the only EU member states to complete national transposition of Directive 2023/970/EU by the June 7, 2026 legal deadline, per the European Commission DG EMPL transposition tracker, August 2026. For Brussels, the geographic coincidence is not incidental: the city where the AI Office operationalises enforcement of Regulation (EU) 2024/1689 is simultaneously the first major EU AI hiring market in which job posting salary disclosure is already active statute. Germany, France, and the Netherlands are still drafting implementing legislation. Belgium's employers are already in scope. The city that wrote the rules is now living under them first.
What Belgium's transposition requires
Belgium's implementing law, enacted through coordinated federal and community legislative action in May 2026 and entering into force June 7, 2026, builds directly on the country's existing 2012 gender pay legislation but adds four obligations that the prior law could not reach.
Salary bands at posting. Every job advertisement must disclose a salary range prior to any interview, without requiring a candidate to ask. A floor without a ceiling does not satisfy the obligation. Brussels AI employers posting senior machine learning engineer roles at €90,000 to €130,000 base (~$98K to $142K equiv at EUR/USD 1.09) must post both figures. The "salaire en fonction de l'experience" convention, Belgian hiring's linguistic equivalent of the German Gehalt nach Vereinbarung documented in this series on August 7 and 15, is no longer legally compliant.
Individual pay information rights. Any employee at a 100-or-more-employee Belgian employer may request pay information for comparable colleagues, disaggregated by gender, with a two-month response obligation. The Institut pour l'Egalite des Femmes et des Hommes (IEFH), which has published Belgium's annual gender pay gap data since 2003, receives annual occupational-group pay gap reports and functions as both data repository and enforcement reference authority.
Joint pay assessment for 250-plus employers. Where the IEFH's analysis identifies a gender pay gap exceeding 5 percent within an occupational group, employers above the 250-employee threshold must conduct a joint assessment with employee representatives within six months. Belgium's private-sector unadjusted gender pay gap ran at approximately 8.5 percent in the IEFH's 2025 reference-year publication. A material share of Belgium's largest AI and technology employers will enter the assessment cycle before the 2027 reporting deadline.
The barema intersection
Belgium's transposition lands on a collective bargaining infrastructure that has no equivalent in France, Germany, or the Netherlands. Belgian sectoral Paritaire Comités (Joint Committees) negotiate mandatory minimum barema: salary scales published by employment group and seniority level. Joint Committee 200 covers white-collar service-sector workers broadly; Joint Committee 218 covers banking; Joint Committee 307 covers technical office functions. The barema are public by design. Any AI engineer covered by PC 200 can consult their function category's minimum at any labour court in Belgium.
The barema system creates a pre-existing transparency floor. Directive 2023/970/EU superimposes two structures the barema cannot provide: the right to know where within the employer's actual salary range a comparable colleague sits, and the obligation to disclose the employer's internal band -- not the collective minimum -- in job postings. Those two obligations are exactly what the Fédération des Entreprises de Belgique (FEB/VBO) sought to resist. Its July 2024 position paper on Directive transposition argued that Belgium's barema system already delivered "un niveau de transparence structurellement superieur a la moyenne europeenne" (a level of structural transparency superior to the European average) and that disclosing internal bands above collective minimums would create competitive distortions against EU institutions and NATO, which operate under their own Staff Regulations exempt from Belgian employment law. The Belgian government proceeded with full on-time transposition. The FEB/VBO's proposed 500-or-more-employee threshold carve-out was not adopted.
Brussels AI employers in scope
ING Belgium, the Brussels-headquartered retail and commercial banking subsidiary of ING Groep, employs approximately 9,000 staff in Belgium. Its AI function spans credit risk modelling, AML pattern detection, and personalisation systems. As a 250-plus employer in the financial sector under Joint Committee 218, ING Belgium is fully in scope for both the annual IEFH reporting and the joint assessment obligations. Active AI postings reviewed by ENTRA in Q2 2026 placed senior data scientists at €95,000 to €130,000 base (~$104K to $142K equiv). ING Belgium's credit-scoring AI systems intersect with Annex III high-risk classification under EU Regulation 2024/1689, Article 6 -- meaning the bank navigates AI Act conformity assessment documentation and Pay Transparency Directive reporting simultaneously. No peer city faces both live frameworks at once.
UCB, the Brussels-headquartered biopharmaceutical group with approximately 8,500 global employees, operates AI functions in drug discovery, genomic data analysis, and patient outcome modelling from Brussels and Braine-l'Alleud. Senior AI and computational biology engineers carry estimated bands of €100,000 to €145,000 base (~$109K to $158K equiv), per ENTRA job board monitoring and one person familiar with UCB's Belgium compensation structure in Q2 2026.
Collibra, the data intelligence platform founded in Brussels in 2008 and now dual-headquartered in Brussels and New York, maintains a Brussels R&D hub employing approximately 400 engineers. Its data catalog and governance platform is used extensively by financial services and pharma clients managing personal data under GDPR Article 5 accountability requirements. Senior data platform engineers at Collibra Brussels carry estimated bands of €90,000 to €125,000 base (~$98K to $136K equiv), per ENTRA Q2 2026 monitoring.
Odoo, the Belgian open-source ERP company founded in Namur and employing approximately 5,000 people globally with its engineering function concentrated in Belgium, has historically compensated below Belgian tech market median -- prioritising mission and equity over base, a posture the company itself has framed in terms of ownership of product and community. Pay transparency disclosure now makes that posture explicitly visible in postings. Senior engineers at Odoo carry posted base bands of €70,000 to €95,000 (~$76K to $104K equiv), per active postings reviewed by ENTRA in Q2 2026. That positioning is now a disclosed fact, not an asymmetric negotiation advantage.
A structural note: EU institutions and NATO Headquarters Brussels operate under their own Staff Regulations and are not subject to Belgian employment law. Their pay scales -- EU Administrator grades AD 9 to AD 13 run approximately €86,000 to €142,000 annually -- have always been public by treaty. Belgian-law employers competing with EU institutions for Brussels AI talent now face a symmetrical disclosure requirement. The institutions disclosed by design; Belgian employers must now disclose by statute.
Candidate market response
Belgium's early transposition is producing a measurable market signal. ENTRA's Q2 2026 data across five EU markets where salary band disclosure is active law identifies a 12 to 18 percent negotiation premium for candidates who enter first-round conversations with a disclosed band available. The mechanism is specific: candidates who know the ceiling before the recruiter call do not anchor below it. The median AI engineer in Brussels who negotiated without a disclosed band accepted 11 percent below the posting ceiling in Q4 2025; the same profile negotiating against a disclosed band accepted 3 percent below in Q2 2026. The information asymmetry that made opaque posting conventions profitable for employers resolves within two hiring cycles once disclosure becomes mandatory.
Belgium's own gap data provides the baseline against which that premium will be measured. The IEFH's first occupational-group reports under the new law, due in mid-2027 for 100-plus-employee Belgian employers, will produce the most granular AI-sector gender pay gap analysis anywhere in the EU. Brussels will become the field test for whether the Directive's mechanism -- disclosure plus information rights plus joint assessment -- closes gaps that aggregate reporting alone did not.
Belgium's 18-month head start
Germany's Pay Transparency implementing legislation is projected for Q4 2026 at the earliest (Bundesministerium fuer Arbeit und Soziales, August 2026). The Netherlands' Wet loontransparantie remains in parliamentary process without a firm enactment date. France's projet de loi transposant la directive has not received a first reading.
Belgium's active-law status gives Brussels AI employers an 18-month operational lead in compliance workflow, IEFH reporting cycles, and candidate communication practices that Berlin, Amsterdam, and Paris will build from scratch in 2027. That lead compounds in three directions. First: Brussels-based employers are developing institutional muscle memory -- IEFH report submissions, band-update protocols tied to Belgium's automatic wage indexation cycle (the loonindex, which adjusts wages quarterly against the health price index), and candidate objection handling -- that their peers in non-transposing markets have not yet begun. Second: Brussels's position as seat of the AI Office means the city's employer cluster navigates AI Act conformity assessment and Pay Transparency Directive reporting simultaneously, producing a compliance architecture with no EU peer. Third: the barema infrastructure means Belgian employers entering the transparency regime already have a published minimum structure to anchor disclosure -- a standing start that French or German employers without comparable collective wage frameworks do not have.
"Le vrai avantage de la Belgique n'est pas d'avoir transpose a temps. C'est d'avoir le systeme de barema qui cree une architecture de base sur laquelle la directive peut s'appuyer," said one Brussels-based HR director at a Belgian financial services firm in a July 2026 conversation with ENTRA. ("Belgium's real advantage is not having transposed on time. It's having the barema system that creates a base architecture the directive can build on.") The directive fills in what the barema cannot provide: the right to know not only the minimum, but the ceiling. In Brussels in August 2026, that right is law.
