68% of active AI and ML job postings from Colorado employers included a disclosed salary band as of Q2 2026, per the ENTRA Job Signal Index Q2 2026, which tracked approximately 14,000 active AI and ML postings across the four largest US mandate and non-mandate markets.[^1] Five years after Colorado's Equal Pay for Equal Work Act (EPEWA, CO HB19-085) took effect on January 1, 2021, the Colorado Department of Labor and Employment (CDLE) has accumulated 2,800-plus formal complaints and levied $841,500 in total fines against non-compliant employers through June 2026.[^2] Denver, home to Palantir's relocated headquarters, Ibotta, Guild Education, and the DraftKings Colorado tech hub, is now America's de facto test lab for what sustained salary transparency enforcement looks like at year five.
Five years of EPEWA enforcement
The mechanics of EPEWA warrant restating because the 2024 amendment, SB23-105, effective January 1, 2024, materially expanded the compliance population.[^3] The original 2021 law required any employer with at least one Colorado employee to post pay ranges and a general description of benefits for all job openings that the employer reasonably expected could be performed in Colorado. SB23-105 removed the one-employee floor and added an explicit remote-posting requirement: any remote job listed by an employer with Colorado operations, or by any employer whose posting may attract a Colorado-based applicant who could perform the work remotely, requires a posted range. That change folded thousands of national remote postings into Colorado's compliance perimeter and was the single largest expansion of the law's reach since its enactment.
CDLE's enforcement arm, the Division of Labor Standards and Statistics (DLSS), has processed 2,800-plus formal complaints since January 2021, a volume that accelerated after SB23-105 took effect.[^2] Fines through June 2026 total $841,500 across resolved cases.[^2] The EPEWA fine structure runs $500 to $10,000 per posting per day of non-compliance. For a mid-size employer with 40 open roles and a 10-day gap between posting date and remediation, the theoretical exposure reaches $200,000 before the first conversation with a DLSS investigator.[^3]
Fewer than 15 employers account for a disproportionate share of resolved fine volume, per CDLE public enforcement records reviewed by ENTRA.[^2] The pattern is consistent: national employers that initially geo-blocked Colorado candidates from seeing job listings absorbed the largest early penalties. CDLE guidance published in 2022 established that geo-blocking to avoid salary disclosure is a per se violation of EPEWA, not a permissible workaround.[^4] The employers that tested that position, lost, and subsequently adopted full disclosure account for roughly 60% of total fine volume, per ENTRA's reading of CDLE enforcement logs.[^2]
Denver's AI employer landscape
Palantir moved its headquarters from Palo Alto to Denver in August 2020, fourteen months before EPEWA took effect.[^5] That timing placed Palantir in Colorado's compliance environment from day one of the law. As a defense-oriented AI company with both commercial and US government contract business, Palantir's posting behavior carries an additional layer of scrutiny: salary transparency creates discoverability that enables government pay scale comparisons in ways that defense contractors historically avoided. ENTRA Job Signal Index monitoring of Palantir's Colorado-identified postings in Q2 2026 found band disclosure on approximately 72% of open roles, four percentage points above the state's 68% median.[^1]
Ibotta, the Denver-based digital promotions platform that listed on Nasdaq in April 2024, employs approximately 800 people at its LoDo Denver headquarters.[^6] Its AI and ML team expanded with its retail media push in 2025 and 2026. ENTRA tracked 23 AI-related open Colorado roles from Ibotta in Q2 2026; 17 carried disclosed bands, a 74% disclosure rate.[^1] Guild Education, the Denver-headquartered workforce development platform backed by Bessemer Venture Partners and valued at $4.4 billion in its 2021 Series F, posted bands on 100% of its 11 Q2 2026 AI and ML Colorado listings, per ENTRA monitoring.[^1] That 100% rate matches Guild's disclosure posture since 2022, when the company adopted full posting compliance ahead of the SB23-105 expansion.
DraftKings operates a 450-person Colorado tech hub focused on product and data engineering.[^7] ENTRA tracked 31 AI-adjacent open roles from DraftKings in Colorado during Q2 2026, covering machine learning, data science, and real-time personalization. Band disclosure on those roles was 65%, at the state median.[^1] EchoStar Corporation, the entity that absorbed Dish Network following the 2023 merger, runs its AI and automation engineering teams from its Meridian, Colorado campus south of Denver. ENTRA tracked 19 AI-adjacent EchoStar postings in Colorado during Q2 2026; 13 carried ranges, a 68% rate, exactly at the state median.[^1] SpaceX, which operates a satellite software engineering office in the Denver metro supporting Starlink ground systems, posted 8 AI-adjacent Colorado roles in Q2 2026 with a 50% disclosure rate, the lowest among the large-employer cohort ENTRA monitored.[^1]
The compliance gap between posting and pay equity

Colorado's 68% is a floor measurement, not an equity measurement. A posted range of $90,000 to $250,000 for a "Machine Learning Engineer" role technically satisfies EPEWA's disclosure requirement while giving a candidate no useful anchoring information. ENTRA Job Signal Index Q2 2026 monitoring found that approximately 14% of Colorado AI postings carry band spreads exceeding $100,000 on a single role.[^1] CDLE guidance updated in March 2025 notes that "unreasonably broad" ranges may constitute a violation, but CDLE has not yet defined the threshold for "unreasonably broad" in rule.[^4]
The distinction matters because EPEWA's pay equity provisions run in parallel with its disclosure provisions. An employer that posts a band and then makes individual offers across a $160,000 spread based on opaque internal criteria is complying with disclosure law while potentially violating the equal pay provisions at the statute's core. CDLE's public enforcement data does not separate disclosure violation fines from pay equity fines, which limits any measurement of whether posting compliance correlates with actual pay compression in practice.
The aggregate data does show a directional relationship. Across ENTRA's Q2 2026 monitoring of the top 25 Colorado AI employers by role volume, the median band spread for senior AI engineering roles is $55,000: a range like $195,000 to $250,000 for a Staff Machine Learning Engineer.[^1] In Texas, where disclosure is voluntary and infrequent, ENTRA monitoring found a median spread of $90,000 on comparable senior engineering roles.[^1] A narrower band does not guarantee equal pay. It does constrain the space in which unequal offers can occur invisibly.
The candidate-side data reinforces that point. ENTRA's Q2 2026 Salary Survey found that AI and ML candidates in mandatory-disclosure markets who received a job offer negotiated first-offer compensation 12 to 18 percentage points higher than counterparts in voluntary-only markets for comparable roles, controlling for seniority and function.[^8] At a $220,000 midpoint, that spread is $26,400 to $39,600 in annual base compensation per hire. For Denver-area candidates, the posted band is the negotiation's starting line. For Austin candidates, the starting line is wherever the recruiter sets it.
Colorado enforcement calendar: Q4 2026 and 2027
Three enforcement developments should be on the calendar for any HR team operating in Colorado.
First: CDLE is scheduled to release Q3 2026 enforcement data in October 2026. The $841,500 cumulative fine total through June 2026 will either accelerate or plateau when Q3 numbers land.[^2] Post-SB23-105 complaint volumes have trended upward each quarter since January 2024. If Q3 confirms acceleration, it will put pressure on peer-state CHROs in states monitoring Colorado's enforcement model for pending legislation, including North Carolina and Georgia, both of which have had draft pay transparency bills circulated in 2026 legislative sessions.
Second: CDLE's Q4 2026 rule-making calendar includes a proposed rule on band-spread adequacy.[^4] Per the Colorado Employment Law Letter's July 2026 reporting on the agency's rulemaking calendar, CDLE has indicated it is evaluating salary band adequacy standards — though the agency has not published a specific threshold in rule as of August 2026. If finalized, any such rule would mark the first instance of any US state regulator addressing the information quality of posted bands, not merely the fact of posting.
Third: The EU Pay Transparency Directive (Directive 2023/970/EU), which required member states to transpose into national law by June 7, 2026, is now moving toward Q1 2027 enforcement.[^9] Palantir, DraftKings, and EchoStar each have European operations within the directive's scope. For those teams, EPEWA compliance since 2021 represents five years of institutional practice on which EU disclosure frameworks will be built. Colorado's enforcement log, whatever its limitations, is now a credential in transatlantic compliance conversations.
Colorado opened this experiment in January 2021 with a disclosure law designed to compress pay gaps, not just publish numbers. Five years of CDLE enforcement, two rounds of legislative refinement, and 2,800-plus complaints later, Denver sits at 68%: the highest AI posting compliance rate in the US. What comes next is the harder problem: whether the numbers on job boards match the numbers on offer letters.
