Silicon Slopes Runs on Borrowed Rules

Utah has no pay disclosure statute. Forty-three percent of Silicon Slopes AI postings carry salary bands anyway — because California and Colorado wrote the rules, and they travel.

Forty-three percent of active AI and ML job postings across Utah's Silicon Slopes corridor carried salary bands in Q2 2026, per the ENTRA Q2 2026 Job Signal Index, which tracked approximately 780 open roles from Adobe's Lehi campus south through Recursion Pharmaceuticals' Salt Lake City headquarters.[^1] Utah has no statewide pay disclosure statute. The figure reaches 43 percent not because Utah acted, but because California's SB 1162 and Colorado's Equal Pay for Equal Work Act travel with the employers that must comply with them — and those employers post nationally.

Utah AI Salary Regulation: No Statewide Disclosure Law

Utah is one of 34 states without a mandatory salary range disclosure law.[^2] The 2026 Utah Legislature general session adjourned sine die in March without enacting a pay transparency bill, per Utah Legislature bill tracking. The operative Utah wage statute is Utah Code Section 34-28-4, which requires employers to notify workers of their pay rate at the time of hire. It is silent on job postings.

Clyde Snow & Sessions, a Salt Lake City employment law firm, assessed Utah employer exposure in an analysis titled "Pay Transparency Laws Are Creeping In: Are Utah Employers Safe?" — finding that the disclosure wave from neighboring Colorado and Washington pulls Utah employers into scope without any Utah state action.[^3] The mechanism is Colorado's Equal Pay for Equal Work Act.

Colorado's EPEWA, administered by the Colorado Department of Labor and Employment, is the dominant enforcement mechanism for Silicon Slopes employers with Colorado operations. As of the CDLE's June 2026 enforcement update, the agency had issued citations with fines totaling $841,500 since the law's January 2021 effective date, received more than 2,800 Part 2 complaints, and completed 199 formal investigations — with 76.6 percent of cases resolving voluntarily after initial compliance letters.[^4] The per-violation fine structure — $500 to $10,000 per incident — means a multi-location employer that posts the same non-compliant listing across Utah and Colorado faces immediate exposure on every Colorado-eligible requisition. Adobe, a California-headquartered employer operating from Lehi, applies its SB 1162-compliant posting posture nationally, eliminating EPEWA exposure entirely. Utah-native employers with Denver satellite offices are not in the same position.

Adobe, Recursion, and NVIDIA: Utah AI Salary Band Compliance

Adobe Lehi. Adobe is headquartered in San Jose and employs AI and ML engineers at its Lehi campus in roles spanning Firefly generative AI systems, Sensei ML infrastructure, and the enterprise AI product organization. California's SB 1162 requires employers with 15 or more employees to include pay scale in job postings, an obligation that extends to any role eligible for a California-based remote candidate. Adobe applies its SB 1162-compliant posture across its national career portal. Lehi-based principal AI engineer roles posted bands ranging to $360,000 base in Q2 2026, per ENTRA's Q2 2026 monitoring of Adobe's public career site.[^5] A candidate in Lehi reads the same band as the San Jose equivalent. The band is not there because Utah required it.

Recursion Pharmaceuticals. Recursion (NASDAQ: RXRX) operates its AI-driven drug-discovery platform from Salt Lake City, with more than 750 employees split between Salt Lake City and Toronto, per ENTRA company data updated February 2026. Its NVIDIA compute partnership and its 2024 acquisition of Exscientia make it the largest industrialized drug-discovery AI operation outside the Bay Area. Two forces drive Recursion's disclosure posture: its NASDAQ-listed status creates investor-facing compensation consistency pressure, and any role posted as remote-eligible in Colorado triggers EPEWA compliance. ENTRA's Q2 2026 monitoring of Recursion's public career portal found salary ranges on senior machine learning engineer and computational biologist postings; entry-level ML engineer roles in the $80,000–$100,000 range also carried bands on publicly posted listings.[^5] Not all Recursion postings carry bands; mid-level roles in the same period showed inconsistent disclosure.

NVIDIA Utah. NVIDIA, headquartered in Santa Clara, applies its SB 1162-driven national posting posture to every remote or hybrid role eligible for a California candidate. Any Utah candidate viewing the same listing reads the same band. NVIDIA's Utah footprint expanded in March 2025, when the Governor's Office of Economic Opportunity, the Utah System of Higher Education, and NVIDIA signed a memorandum of understanding covering AI education and workforce development.[^6] The partnership covers eight USHE institutions: the University of Utah, Utah State University, Utah Valley University, Weber State University, Utah Tech University (St. George), Southern Utah University, Snow College, and Salt Lake Community College. Educators at those institutions are now completing NVIDIA Deep Learning Institute University Ambassador certification. The first cohort trained under the expanded curriculum is projected to enter the labor market in Q2 2027.

ENTRA Pay Transparency Index: Silicon Slopes

Methodology — ENTRA Q2 2026 Job Signal Index (Silicon Slopes corridor) ENTRA tracked 780 active AI and ML job postings from employers with physical operations within the Salt Lake City–to–Draper corridor between April 1 and June 30, 2026. Postings were sourced from employer career portals, LinkedIn, and Indeed. A posting was counted as carrying a salary band if it included both a minimum and maximum dollar figure. Q2 2025 tracking of the same corridor returned 590 postings with a 31% band disclosure rate. The Q2 2026 figure of 43% represents a 12-percentage-point year-over-year increase, driven by expanded national posting volume from California-headquartered employers rather than a shift in Utah-native employer behavior. ENTRA salary band figures are sourced from publicly posted role listings only; no proprietary employer data was used.

The ENTRA Pay Transparency Index scores for Adobe, Recursion, and NVIDIA reflect Q2 2026 posting behavior across the corridor:

  • Adobe (Lehi campus): 94% of AI and ML postings carried a salary band. Band disclosure was present on 100% of staff-engineer-level and above postings.
  • Recursion Pharmaceuticals: 61% of AI-tagged postings carried a band. Senior roles (principal engineer, senior scientist, senior ML engineer) showed higher compliance; associate and mid-level roles were inconsistent.
  • NVIDIA (Utah-linked and US-remote postings): 88% of roles eligible for remote-US or Utah-based candidates carried a band under NVIDIA's SB 1162-driven national posture.

Utah-native SaaS operators in the same corridor — Domo, Weave, Entrata, Podium — averaged 14% band disclosure across AI and software engineering postings in Q2 2026, per ENTRA tracking. The corridor's aggregate 43% rate is a weighted average of two distinct populations: California- and Colorado-registered employers posting at high rates, and Utah-native employers posting at rates consistent with a state where no law requires them to disclose anything.

The practical cost lands on the candidate. ENTRA's Q2 2026 recruiter network survey, covering 168 Silicon Slopes AI and engineering placements, found that Utah-based candidates accepted initial offers an average of 9.1 percent below their interview-assessed compensation ceiling when no posted salary range was available.[^1] On a $180,000 base, that gap is $16,380 per year — a deficit that annual merit cycles at Utah-native employers have not historically closed.

Three Pay Transparency Signals: Silicon Slopes Through Q1 2027

The Utah Legislature's 2027 general session opens in January. No pay transparency bill had been filed as of August 24, 2026, per Utah Legislature bill tracking. The Clyde Snow analysis on creeping compliance risk from neighboring states remains the most specific forward signal available from Utah's employment bar.[^3] Whether the 2027 session produces a filed bill — or whether the Colorado EPEWA expansion to cover employers who merely solicit remote candidates in Colorado tightens enforcement pressure further — is the primary state-level variable.

Recursion's Q4 2026 earnings cycle and the post-Exscientia integration hiring wave will produce a discrete cluster of senior AI roles anchored to Salt Lake City. If the band architecture visible on Recursion's senior postings in Q2 2026 extends consistently across a Q4 hiring wave of several dozen roles, the public biotech AI band will become the standing reference point for the entire Wasatch Front senior ML market. If Recursion posts a subset of those roles without ranges, the corridor loses its cleanest private-sector disclosure anchor.

The NVIDIA-USHE cohort reaches the labor market in Q2 2027. Eight Utah public institutions are producing the first class under the March 2025 memorandum of understanding.[^6] Whether Utah-native employers post salary bands to compete for that cohort — or rely on the state's non-disclosure default to negotiate below the compensation ceiling — will establish whether Silicon Slopes narrows its gap through employer self-interest or continues to depend on rules written in Sacramento and Denver. The same dynamic plays out in the Austin AI pay transparency corridor, where Texas employers face identical structural incentives.

Utah does not need a disclosure statute for the top tier of its AI engineering market to price transparently. It needs one for everyone else.
